The illegal trafficking of narcotic substances contributes to the spread of drug addiction as a socially dangerous phenomenon, leading to harmful consequences for the health of citizens and influencing the increase in crime.
The Prosecutor's Office of the Braslav District supported the state prosecution in the Braslav District Court in a criminal case against M. for committing a crime under part 1 of Article 328-1 of the Criminal Code of the Republic of Belarus, involving the illegal transportation of narcotic substances across the State Border of the Republic of Belarus, and part 1 of Article 328 of the Criminal Code of the Republic of Belarus, concerning the illegal possession and transportation of narcotic substances without the intent to sell.
During the court investigation, it was established that on one of the days in August 2022, while traveling on a scheduled bus route "Riga-Minsk" from the territory of the Republic of Latvia to the territory of the Republic of Belarus, M. was carrying a crushed plant-based substance weighing 5.36 grams, which is a dangerous narcotic substance – marijuana, and crossed the State Border of the Republic of Belarus, thereby intentionally and illegally transporting the aforementioned narcotic substance across the State Border of the Republic of Belarus with the Republic of Latvia.
Furthermore, while in a state induced by the consumption of narcotic and psychotropic substances, he acquired, without intent to sell, a dangerous narcotic substance – marijuana, weighing no less than 2.36 grams, which he kept with him until it was discovered during a customs inspection.
In the court session, M. fully admitted his guilt in the illegal transportation of narcotic substances across the State Border of the Republic of Belarus and in the illegal possession and transportation of narcotic substances without intent to sell. In conjunction with the conclusions of expert examinations, protocols of operational-search activities, investigative actions, physical evidence, and other written materials of the case, thoroughly examined during the court investigation, M.'s guilt in committing the crimes provided for in part 1 of Article 328-1 and part 1 of Article 328 of the Criminal Code of the Republic of Belarus was proven in full.
Considering the position of the state prosecution, the court found M. guilty of committing a crime under part 1 of Article 328-1 and part 1 of Article 328 of the Criminal Code and sentenced him to 3 years of imprisonment in a correctional colony under enhanced regime without a fine.
The verdict has not yet entered into legal force and may be appealed and contested in the appellate procedure.
