Procedure for the Creation and Reconstruction of Works of Monumental and Monumental-Decorative Art
Main Provisions
The procedure for the creation and reconstruction of works of monumental and monumental-decorative art in the Republic of Belarus is determined by the resolution of the Council of Ministers of the Republic of Belarus dated September 19, 2008 No. 1372 (as amended by the resolution of the Council of Ministers dated January 14, 2022 No. 26).
Works of monumental and monumental-decorative art include monumental sculpture, monumental-decorative sculpture, monumental painting, decorative finishing forms, and artistic fabrics.
According to current legislation, for the creation of most works of monumental and monumental-decorative art, it is necessary to obtain permission from the Ministry of Culture and make a decision by the city or district executive committee; in some cases (for the most significant objects), approval from the President of the Republic of Belarus or the regional executive committee is required.
All works of monumental and monumental-decorative art (regardless of funding sources) must be considered step by step by the republican (objects that need to be approved by the President) or regional council on monumental and monumental-decorative art (operating under the regional executive committee's culture department) before their creation.
Works of monumental and monumental-decorative art dedicated to historical events or personalities are additionally coordinated with the State Scientific Institution "Institute of History of the National Academy of Sciences of Belarus" (including textual solutions).
Important Note
The norms of the Regulation on the procedure for the creation (reconstruction) and acceptance of works of monumental and monumental-decorative art on the territory of the Republic of Belarus (hereinafter referred to as the Regulation) do not apply to gravestones installed at the expense of relatives or close ones.
After the installation of a work of monumental (monumental-decorative) art, it is necessary to conduct its state acceptance. Final settlements with the authors and enterprises (individuals) that produced the work can only be made after state acceptance by the regional or republican commission in the established manner (p. 26 of the Regulation).
Responsibility and Additional Information
For violations of the established procedure for the creation of works of monumental art, the guilty parties are held accountable in accordance with current legislation, and created objects (as well as objects that have not passed state acceptance) are subject to dismantling (p. 36 of the Regulation).
