Penalties for the illegal trafficking of narcotic drugs and psychotropic substances!

The Prosecutor's Office of Braslaŭ District supported the state prosecution in the Braslaŭ District Court in a criminal case against T. for committing a crime under part 1 of article 328 of the Criminal Code of the Republic of Belarus – illegal acquisition and storage of psychotropic substances without the purpose of sale.

During the court investigation, it was established that T., on one of the days in July 2023, while on the territory of Braslaŭ District, acquired a crystalline substance of white color, weighing no less than 0.77 grams, through electronic correspondence in the global computer network Internet, which is a particularly dangerous psychotropic substance – "para-methylamphetamine", which he stored with him without the purpose of sale until the moment of personal search conducted by the internal affairs officers.

In the court session, T. fully admitted his guilt in the illegal acquisition and storage of psychotropic substances without the purpose of sale. In conjunction with the conclusions of expert examinations, protocols of operational-search activities, investigative actions, physical evidence, and other written materials of the case, thoroughly examined during the court investigation, T.'s guilt in committing the crime under part 1 of article 328 of the Criminal Code of the Republic of Belarus was proven in full.

Taking into account the position of the state prosecution, the court found T. guilty of committing a crime under part 1 of article 328 of the Criminal Code of the Republic of Belarus and sentenced him to imprisonment for a term of 2 years. In accordance with the provisions of article 78 of the Criminal Code of the Republic of Belarus, T. was established a two-year probation period, and he was also obliged to pay a criminal-legal compensation to the state in the amount of 80 basic units totaling 2,960 rubles.

The verdict has not entered into legal force and may be appealed and contested in the appellate procedure.
