Inevitability of Punishment

The prosecutor's office of the district supported the state prosecution in the court of the Braslav district in a criminal case against a resident of the Braslav district, S., accused of committing a crime under part 2 of article 209 of the Criminal Code (acquisition of property by abuse of trust (fraud), committed repeatedly).

The prosecuting authority accused S. of having, during the period from October to December 2018, with a unified intent to unlawfully and gratuitously acquire someone else's property through fraud, while on the territory of Braslav, abusing the trust of the victim D., acquired the victim's property for a total amount of more than 570 rubles. It was established that during the specified period, S. persuaded D. to purchase two mobile phones in his name with the condition of deferred payment. At the same time, the accused convinced the victim that he would independently make the monthly payments for the purchased phones. However, subsequently, S. did not make the payments, resulting in a significant debt arising under the contracts concluded in the name of the victim D. The materials of the criminal case indicate that the accused S. initially did not intend to pay for the mobile phones and did not have such an opportunity, as he had not worked anywhere for a long time and had no means of subsistence.

Considering the evidence presented by the state prosecutor, the court found S. guilty of committing a crime under part 2 of article 209 of the Criminal Code and sentenced him to restriction of freedom with placement in an open-type correctional institution for a period of 3 years. Additionally, the income obtained by the accused through criminal means was recovered from him.
