Illegal hunting

The Prosecutor's Office of the Braslav District supported the state prosecution in court in a criminal case against local residents A. and V., who are accused of committing a crime under part 2 of Article 282 of the Criminal Code of the Republic of Belarus, namely hunting without the proper permit, using prohibited tools and methods (illegal hunting), which caused significant damage.

As established during the court investigation, the accused, on the night of February 20 to 21, 2022, while in a state of alcohol intoxication, acting jointly and in agreement, as a group of persons by prior conspiracy, being in an area near the village of Kondershchina in the Braslav District, which belongs to the hunting grounds of the state nature conservation institution "National Park 'Braslav Lakes'", illegally obtained one specimen of a wild animal – a boar.

As a result of their illegal actions, the accused A. and V. caused environmental damage amounting to 120 basic units totaling 3,840 rubles, which constitutes significant damage.

During the court hearings, the accused A. and V. fully admitted their guilt in the committed crime and explained the circumstances of the crime they committed. Also, during the court investigation, the guilt of A. and V. in the incriminated act was fully confirmed. The testimonies of prosecution witnesses, expert conclusions, protocols of investigative actions, physical evidence, and other written materials of the case, thoroughly examined during the court investigation, reliably restored the events that occurred.

The prosecutor of the Braslav District, in the interests of the state represented by the Braslav Interdistrict Inspection for the Protection of Animal and Plant Life, filed a civil claim for the recovery from the accused in favor of the state of the damage caused as a result of the illegal hunting of the boar, in the amount of 3,840 rubles, and for the recovery from the accused in favor of the state of the value of the illegally obtained product in the amount of 672 rubles.

The claims of the prosecutor of the Braslav District are confirmed by the materials of the criminal case and were satisfied in full.

Taking into account the position of the state prosecutor and the evidence presented, the court of the Braslav District rendered a guilty verdict. Based on the data about the personalities of A. and V., the nature and degree of public danger of the actions committed by the accused A. and V., under part 2 of Article 282 of the Criminal Code of the Republic of Belarus, a sentence was imposed in the form of restriction of freedom without sending to an open-type correctional institution for a period of 1 year and 8 months and 1 year and 3 months respectively, with deprivation of the right to engage in activities related to hunting for a period of 5 years.

The court's verdict has entered into legal force.
