From love to hatred
The prosecutor of the Braslav district has initiated a criminal case under Article 186 of the Criminal Code – threat of murder, causing serious bodily harm, if there were grounds to fear its implementation. The basis for initiating the criminal case was the violation of the rights and legitimate interests of an elderly person.
Thus, a negligent adult son, in a state of alcohol intoxication, twice threatened to kill his elderly mother, while causing her bodily harm. However, the mother, having forgiven her son's behavior, did not wish to hold him accountable.
According to part 5 of Article 26 of the Criminal Procedure Code, the prosecutor has the right to initiate a criminal case for crimes even in the absence of a statement from the victim, if they affect significant interests of the state and society or are committed against a person who is in a service or other dependency on the accused or for other reasons unable to independently defend their rights and legitimate interests.
Thus, the prosecutor, if necessary, protects the rights and interests of citizens, which leads to the impossibility of terminating the criminal case.
The Braslav district court found resident P. guilty of committing a crime under Article 186 of the Criminal Code and imposed a penalty in the form of arrest. The court's verdict has entered into legal force as it was not appealed or contested.
