Prosecutorial oversight of compliance with labor protection and safety regulations in agricultural organizations of the Braslaŭ district

The Prosecutor's Office of Braslav District conducted an inspection in August of this year to assess compliance with labor discipline and safe working conditions in the agricultural organizations of the district, during which violations of labor protection legislation were identified.

The creation of conditions for sustainable development of the agro-industrial complex is defined by the Directive of the President of the Republic of Belarus dated 04.03.2019 No. 6 "On the Development of Rural Areas and Increasing the Efficiency of the Agricultural Sector" (hereinafter referred to as the Directive) as one of the most important strategic goals of state policy.
According to the provisions of the Directive, the heads of agricultural organizations must ensure effective development of the organizations, maintain order, improve the territories and production areas, and preserve property.

Employees of agricultural organizations must strictly adhere to the rules of internal labor regulations, the requirements of other documents regulating labor discipline issues, and ensure compliance with established requirements for production processes and the quality of produced goods and performed works.

For example, in the repair workshop of one of the agricultural enterprises in the district, no stops (at least two) were installed under the wheels of a tractor that was being repaired to prevent its spontaneous movement, which constitutes a violation of paragraph 49 of the Labor Protection Rules in Agriculture and Fisheries, approved by the resolution of the Ministry of Labor and Social Protection of the Republic of Belarus and the Ministry of Agriculture and Food of the Republic of Belarus dated 05.05.2022 No. 29/44 (hereinafter referred to as Resolution No. 29/44).

In accordance with Resolution No. 29/44, it is prohibited to use and store substances (liquids) contained in unmarked containers (vessels) on the organization's premises. At the same time, in the repair workshop of the machine yard, a transparent polymer container with a volume of 1 liter, labeled "Fanta", contains a transparent liquid, the purpose of which is not established.

The sites for collecting and storing bulky waste scrap and waste of ferrous and non-ferrous metals (scrap metal), construction materials, are not kept clean. The sites are not mowed. The canopy over the construction materials storage area is partially destroyed.

Appropriate safety signs have not been installed on machines that have not been used for a long time.

The causes and conditions contributing to these violations include improper performance by the officials of the enterprise of the requirements of labor protection legislation, insufficient knowledge of the current legislation by specialists, as well as the lack of proper departmental control by the management of enterprises over the work of subordinates.

As a result of the inspection, measures of prosecutorial response have been taken.
