Official forgery
Criminal liability for crimes against the interests of service is intended to protect society and its citizens from corruption and socially dangerous acts committed by officials in the course of their duties through the use or improper performance of the powers granted to them.
These crimes pose an increased public danger as they undermine the principles of state governance, equality, and social justice, threatening the moral foundations of society.
The Prosecutor's Office of the Braslav District supported the state prosecution in the Braslav District Court in a criminal case against D. – the foreman of a production team in livestock farming at one of the agricultural enterprises in the district for committing a crime under part 1 of Article 427 of the Criminal Code of the Republic of Belarus – the deliberate provision of false information and records in official documents by an official, forgery of documents, and the preparation and issuance of knowingly false documents, committed for mercenary and other personal interests, in the absence of signs of a more serious crime (official forgery).
During the court investigation, it was established that the accused D., being an official, intentionally, for mercenary interests, as well as for other personal interests, in order to conceal the shortage of cattle at one of the agricultural enterprises in 24 stages, personally entered knowingly false information into official documents, forged official documents, prepared and issued knowingly false documents: commodity invoices, acts of withdrawal of animals and poultry in form 302-APK, based on which she prepared and entered knowingly false information into official documents: monthly "Reports on the Movement of Livestock and Poultry on the Farm" in form 311-APK.
In the court session, D. fully admitted her guilt in the committed crime and explained that indeed, in order to conceal the death of cattle, she systematically entered unreliable information into official documents from May 2020 to November 2021, as well as personally forged and issued counterfeit documents regarding the sale of deceased cattle to third parties.
During the court investigation, all evidence presented by the state prosecution, including witness testimonies, protocols of investigative actions, numerous material evidence, and other written materials of the case, were thoroughly examined. D.'s guilt in the crime charged against her was proven in full.
Considering the position of the state prosecution, the court found D. guilty of committing the crime provided for in part 1 of Article 427 of the Criminal Code and sentenced her to restriction of freedom for a period of 1 year without sending her to an open-type correctional institution.
The verdict has not entered into legal force.
