Compliance with Anti-Corruption Legislation

The Prosecutor's Office of the Braslaŭ District conducted an inspection this year regarding compliance with anti-corruption legislation at the OAO "Braslav Torfobriket Plant" as part of its supervisory activities.

Article 5 of the Law of the Republic of Belarus dated 15.07.2015 No. 305-Z "On Combating Corruption" stipulates that the fight against corruption is carried out by state bodies and other organizations through the comprehensive application of measures, including planning and coordinating activities to combat corruption, as well as restoring violated rights and legitimate interests of individuals and legal entities, eliminating other harmful consequences of offenses that create conditions for corruption, and corruption offenses.

An important role in countering manifestations of corruption is assigned to anti-corruption commissions; however, as the conducted analysis showed, there are organizational shortcomings in their activities, including in the planning of anti-corruption measures.

At the same time, it was established that the anti-corruption commission at OAO "Braslav Torfobriket Plant" did not ensure the fulfillment of its tasks related to preventing corruption.

In particular, the study of the commission's work plans and the minutes of its meetings showed that the activities developed for the year do not contain specific measures capable of effectively countering manifestations of corruption.

Moreover, in violation of legal requirements, the work plans of the commission with a list of issues to be considered at the commission's meetings were not timely posted on the official website of OAO "Braslav Torfobriket Plant". The official website also lacks information about the date, time, and place of the commission's meetings.

In violation of anti-corruption legislation, the organization of work on the execution of written commitments to comply with anti-corruption restrictions, as provided for in Articles 17-20 of the Law, at OAO "Braslav Torfobriket Plant" was inadequate.

The study of the practice of obtaining written commitments from employees of OAO "Braslav Torfobriket Plant" established that their content is not personalized, and they are drafted without regard to the official position, which, in turn, may mislead regarding the scope of restrictions that apply directly to a specific individual.

Overall, the analysis of anti-corruption commitments showed that the content of the commitments is not personalized, and the commitments are drafted without regard to the official position of each specific individual.

As a result of the inspection, it was established that employees of OAO "Braslav Torfobriket Plant" generally comply with the procedure for organizing and conducting procurement procedures for goods (works, services) by the institution, including at the expense of its own funds.

At the same time, isolated violations of procurement legislation were identified.

The decision of the supervisory board of OAO "Braslav Torfobriket Plant" approved the procedure for procuring goods (works, services) at the expense of its own funds (hereinafter referred to as the procedure).

However, some provisions of the procedure are not aligned with Resolution No. 229 and contradict legal requirements.

The main reasons for the identified violations are insufficient knowledge of the requirements of anti-corruption legislation and procurement legislation by the officials of OAO "Braslav Torfobriket Plant", as well as their inadequate performance of official duties, low executive discipline, which was facilitated by reduced control from management over the work of subordinate employees.

Based on the results of the inspection, the district prosecutor submitted a proposal to the director of OAO "Braslav Torfobriket Plant" requiring the elimination of the identified violations of anti-corruption legislation.
