Typical Violations of Legislation in the Field of Security Activities
One form of control over the security activities of organizations protecting their owned facilities (property) is the conduct of technical (technological, verification) events.
During these events, compliance by organizations, their separate subdivisions, and security personnel with the requirements of the Law of the Republic of Belarus "On Security Activities" and other regulatory legal acts governing the procedure for carrying out security activities is established.
Based on the results of this form of control, if violations are identified at the facilities or on the territory of the subject, an order for their elimination within the established timeframe is issued. No liability measures are applied provided that the subject rectifies the violations within the specified timeframe and notifies the supervisory authority in writing, attaching supporting materials. If the identified violations are not rectified, liability measures are applied in accordance with the law.
Typical violations of legislation identified during the conduct of technical (technological, verification) events include:
security personnel have not provided documents confirming the absence of a criminal record and charges of committing a crime, confirming that they are not on preventive registration with internal affairs bodies due to unlawful behavior, information about the non-annulment in the established legal order of permits for the storage and carrying of weapons, information about not being recognized as incapacitated or partially incapacitated in the established manner;
security personnel have been allowed to perform duties without undergoing an initial fitness check for actions in conditions related to the use of special means (if available) and physical force;
security personnel do not undergo periodic fitness checks for actions in conditions related to the use of special means (if available) and physical force;
security personnel have been allowed to perform duties without passing a qualification exam on issues related to security activities in the manner established by the Ministry of Internal Affairs; there is no documentation on the procedure for organizing and conducting special training for security personnel;
security personnel perform duties without service identification cards and badges or, if service identification cards and badges are present, they are of an unapproved sample;
security personnel have been allowed to perform duties without undergoing medical examinations in the manner established by the Ministry of Health in coordination with the Ministry of Labor and Social Protection;
security personnel do not undergo periodic medical examinations in the manner established by the Ministry of Health in coordination with the Ministry of Labor and Social Protection.
The above-mentioned violations are classified under Article 24.37 of the Code of Administrative Offenses of the Republic of Belarus as violations of the conditions and rules for carrying out security activities.
